Terms of Service
Last updated: 26 October 2026 · Effective for RanchRubric at ranchrubric.ai
RanchRubric (ranchrubric.ai) is operated by 48U Ranch LLC, Magnolia, Texas, USA (“48U”, “we”). By creating an account, accepting an invitation, or using the service you agree to these terms. If you use RanchRubric for an organization, you agree on its behalf and confirm you are authorized to do so. If you do not agree, do not use it.
1. What RanchRubric is
RanchRubric is a console for assessing and comparing data center facilities that your organization owns, leases, colocates in or is evaluating. It scores facilities against 48U rubrics or your organization’s own templates. It reads details from documents you upload, records compliance reviews and sign-offs, tracks risks and remediation, and produces reports. It records what your organization enters and does arithmetic on it. It does not inspect facilities itself.
2. Not professional advice or certification
Scores, grades, composites, confidence values, vendor-claim comparisons, details read from documents, provider baselines and benchmarks are tools to support your own judgment. They are not an engineering opinion, an audit, an attestation, or a certification of any kind (for example an Uptime Institute Tier rating or a SOC report). Details read automatically from documents can be wrong or incomplete and must be checked against the source.
The provider and facility catalog and the provider baselines are compiled from public sources, cite those sources, and may be incomplete or out of date. Provider names are used for identification only. RanchRubric is not affiliated with or endorsed by any provider, and a listing is not a recommendation.
3. Accounts, organizations and access
- You must be at least 18 and using RanchRubric for business purposes.
- During early access, accounts are created by invitation.
- Organization admins control who is a member and in which role (admin, assessor or viewer), and are responsible for their members’ use. One person can administer at most two organizations.
- Two-step verification is required on every account: an authenticator app (time-based codes) is set up at first sign-in and used at every sign-in, and it cannot be switched off. You can replace your authenticator yourself from Account & security after confirming a current code. If you lose it, you can sign in once with one of your one-time recovery codes and must then set up a new authenticator; without a code, your organization admin can reset it (an admin’s is reset by 48U). Nobody can reset another person’s authenticator except as described here.
- Keep your password, authenticator and recovery codes secure, and store recovery codes apart from your phone: anyone with your password and an unused recovery code can replace your authenticator. Tell us promptly at the address below if you believe an account or a recovery code has been compromised. Records of recovery attempts and security events are kept for 90 days, as described in the Privacy Policy.
4. Your organization’s data
Your organization’s data is yours. We claim no ownership of it. You grant us only the license needed to store, process, back up and display it in order to provide the service to your organization, and the benchmark license in section 5 if you opt facilities in. How it is handled is described in the Privacy Policy, which forms part of these terms.
You confirm that your organization has the right to upload and use each document it adds, including third-party reports received under a non-disclosure agreement. Your organization is responsible for complying with those agreements. RanchRubric’s NDA handling and destroy-by tools help, but they do not do this for you.
Keep your own exports. An organization admin can export the organization’s data at any time.
5. Benchmarks
When an organization admin opts a facility in to platform benchmarks, your organization grants 48U a non-exclusive, royalty-free license to use the approved assessment scores of that facility on 48U rubrics in anonymized aggregate benchmarks, including benchmark reports that 48U may sell. The conditions are those in the Privacy Policy: at least five independent organizations per facility, approvals covering at least 80% of rubric weight, dates shown only by quarter, and never documents, notes, findings or identities. The aggregate benchmarks belong to 48U. Opting out removes the facility from future releases. You agree not to attempt to identify contributors from any benchmark.
6. Optional encryption
If your organization turns on file encryption, the passphrase stays in your members’ browsers and is never sent to us. We cannot recover a lost passphrase or decrypt your files. Keeping the passphrase safe is your organization’s responsibility.
7. Acceptable use
Do not:
- attempt to access another organization’s data;
- probe, overload or degrade the service, or reverse-engineer or bypass its security, including two-step verification;
- scrape or bulk-copy the catalog;
- upload malware;
- use the service to store unlawful content or to facilitate unlawful activity.
Accounts or organizations used in these ways may be suspended or removed without notice.
8. Fees
RanchRubric is in early access and is currently provided without charge. There are no paid plans, trials or subscriptions, and no payment details are collected. If 48U introduces fees, it will publish them and the related terms before they apply, and nothing will be charged without your organization’s express agreement. Ending an account or organization follows section 13 and the Privacy Policy.
9. AI features
RanchRubric contains an optional AI-assisted document extraction feature that is currently switched off for everyone. It will not be switched on until 48U has a data processing agreement with a model provider. Even then it would apply only to organizations whose admin turns it on, under terms presented at that time.
10. The service
The service is provided as-is and as-available, without warranty of any kind, express or implied, including fitness for a particular purpose. It is in early access and maintained on a best-effort basis; availability, correctness and continuity of service are not guaranteed, and features may be changed or removed. We may suspend the service for maintenance or security at any time.
11. Limitation of liability
To the fullest extent permitted by law, 48U Ranch LLC, its members, and anyone working on its behalf are not liable for any loss or damage arising from your use of or inability to use the service, or from reliance on anything it displays. This covers direct, indirect, incidental, consequential or other losses, including loss of data, facility selection or contracting decisions, outages, and audit or regulatory consequences. To the extent permitted by law, our total liability is limited to the greater of US $100 or the fees your organization paid for the service in the twelve months preceding the event giving rise to the claim. The exclusions and limits in this section do not apply to fraud, willful misconduct, gross negligence, or liability that applicable law does not permit us to exclude or limit.
12. Intellectual property
48U Ranch LLC owns the service and its code and design. It also owns the 48U rubrics, checklists and anchors, the compiled catalog and baselines, aggregate benchmarks, and the RanchRubric name and marks. Your organization may use them within the service for its own assessments. Templates your organization copies from a 48U rubric may be used for the same purpose. You may not copy, resell or redistribute the service, the rubrics or the catalog.
13. Ending an account or organization
You may stop using the service at any time. An organization admin may export the organization’s data and ask us in writing to close the organization, and you may ask us to delete your own account. Both follow the Privacy Policy. We may end an account or organization for breach of these terms, or if the service is discontinued; in that case we will make reasonable efforts to give notice and time to export.
14. Changes to these terms
These terms may be revised as the service evolves. The date at the top is the current revision. Continuing to use the service after a revision takes effect means you accept the revised terms.
15. Governing law
These terms are governed by Texas law, except where applicable law requires otherwise. Disputes must be brought in the state or federal courts serving Montgomery County, Texas, unless applicable law gives you a right to bring a claim elsewhere. Nothing in these terms limits rights or remedies that cannot legally be waived. If any part of these terms is found unenforceable, the rest remains in effect. These terms and the Privacy Policy are the entire agreement between you and 48U about the service, unless your organization has signed a separate written agreement with 48U.
